Terms of purchase for the Malachi full version
This is a translation for your convenience. The German version (Kaufbedingungen) is legally binding; the language of the contract is German.
1. Seller and scope
The seller is David Mark Meyer, Elisenweg 20, 72762 Reutlingen, Germany (see legal notice). These terms apply to purchasing the Malachi full version in the shop of this website. For purchases via Google Play, Google Play's terms apply in addition.
2. What you buy
- Malachi is free. The full version unlocks additional features described on the full version page.
- You receive a one-time license without time limit. It is not a subscription; there are no further costs.
- The license is bound to a device (device code from the app). With the order number and recovery code you can transfer it to another device, up to three activations in total.
- Keep the recovery code safe. We don't store it in plain text and cannot recover it.
3. Conclusion of the contract
By creating an order in the shop you make a binding offer to buy the full version. The contract is concluded when we provide the license after receiving payment. The language of the contract is German. You can retrieve the contract text (order and invoice) in the shop as long as the order is stored.
4. Price and payment
- The price is shown in euros in the shop. In accordance with § 19 UStG (German VAT Act), no VAT is charged (small business regulation).
- You pay with Monero (XMR) or Bitcoin (BTC). The amount due is calculated from the current exchange rate when you order and is valid for 24 hours.
- You bear the network fee of your transfer. If you pay too little, you can pay the rest within the validity period. If you pay too much, we refund the excess on request with the order number, minus the network fee.
- An order that is not paid within 24 hours expires.
5. Provision
The license is provided as soon as the payment is confirmed on the network – with Monero usually after a few minutes, with Bitcoin possibly later depending on network load. When you buy in the app, the app applies the license automatically; when you buy in the Tor Browser, you paste the license proof into the app.
6. Right of withdrawal
As a consumer you have a right of withdrawal. Details, including its early expiry, are in the information on the right of withdrawal.
7. Warranty and updates
The statutory rights for defects in digital products apply (§§ 327 et seq. BGB, German Civil Code). We provide updates for the full version that are necessary for its function and security, at least for as long as you can expect this given the nature of the product. Malachi requires an Android device and internet access; the connection between devices can depend on networks we have no influence on.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. In case of slight negligence we are only liable for breach of an essential contractual obligation, limited to the foreseeable damage typical for the contract. Malachi stores data only on your device; you are responsible for backing up your data yourself.
9. Data protection
See the privacy policy. The shop asks for neither name nor address nor email address.
10. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
